Negligent Homicide Defense Attorneys

Negligent homicide is defined by RSA 630:3.  The two key elements are causing the death of another person, and doing so negligently.  This is different from intentionally causing the death, which would be murder. New Hampshire criminal law defines negligence as a gross deviation from how a reasonable person would have acted under the same circumstances.

Negligent homicide is normally a class B felony punishable by up to 3 ½ to 7 years in prison.  Often, but not always, negligent homicide is the result of the negligent operation of motor vehicle, in which case the defendant’s driver’s license can be suspended for 7 years.

If the negligent homicide is the result of DWI, the offense is a class A felony punishable by up to 7 ½ to 15 years in prison.  In that case, the loss of license must be indefinite but the driver can apply to get it back after 7 years.
